Welcome to The Flight Wall ("we," "us," "our"). These Terms of Service ("Terms") govern your use of our website, theflightwall.com (the "Site"), our mobile application (the "App"), and your purchase and use of our physical "Flight Wall" devices (the "Device").

By accessing the Site, downloading or using the App, or using a Device, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Site, App, or Device.

1. Description of Service

The Flight Wall provides a Device that displays real-time or near-real-time flight information for a user-defined geographical area. The App allows users to connect to their Device via Wi-Fi, configure settings (such as geographical bounds and data filters), and manage their Device. The Site provides information about our products and a platform for purchasing them.

2. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to purchase a Device or create an account to use the App. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

3. Use of the App and Device

a. Setup and Device-Based Identification: No user account is required to use the App or Device. During setup, the App identifies your Device using device-specific identifiers (such as a serial number or MAC address). You are responsible for safeguarding your Device and any network credentials, and for all activities performed via your Device.

b. Wi-Fi Connection: The App and Device require a stable Wi-Fi connection to function. You are responsible for providing and maintaining this connection. When you use the App to connect your Device to your Wi-Fi network, you authorize the App to transmit the necessary credentials (such as your Wi-Fi SSID and password) to the Device. We are not responsible for any issues, security breaches, or data charges related to your Wi-Fi network.

c. Configuration: The App allows you to set geographical boundaries and filters for the flight data displayed on your Device. You are solely responsible for these settings.

d. Prohibited Conduct: You agree not to:

• Use the Site, App, or Device for any illegal or unauthorized purpose.
• Modify, adapt, reverse-engineer, or hack the App or Device.
• Attempt to gain unauthorized access to our servers or any user accounts.
• Interfere with or disrupt the operation of the Site, App, or the data streams that power the Device.
• Use any automated system to access our Site or App in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

4. Purchases

All purchases of Devices through our Site are subject to our Sales Policy, which may be published separately. All sales are final, subject to our limited warranty and any applicable return policies.

5. Data Accuracy Disclaimer

The flight information displayed on the Device is sourced from third-party data providers. We do not guarantee the accuracy, completeness, timeliness, or reliability of this flight data. Third-party flight information may be inaccurate, delayed, or incomplete. The data is provided for informational and entertainment purposes only and must not be used for navigation, safety of flight, or any other purpose where inaccurate data could lead to death, personal injury, or property damage. You agree that your use of or reliance on this data is at your own sole risk.

6. Intellectual Property

All content on the Site and in the App, including text, graphics, logos, software, and user interface elements, is the property of The Flight Wall or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for the purpose of configuring and interacting with your Device.

7. Limitation of Liability

To the fullest extent permitted by law, The Flight Wall, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• (a) Your use of or inability to use the Site, App, or Device;
• (b) Any unauthorized access to or use of our servers and/or any personal information stored therein;
• (c) Any interruption or cessation of transmission to or from our services;
• (d) Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;
• (e) Any errors, inaccuracies, or omissions in any content or data (including flight data);
• (f) Your Wi-Fi network security or performance.

In no event shall our aggregate liability for all claims related to the Site, App, and Device exceed the total amount paid by you to us for the Device.

8. Indemnification

You agree to defend, indemnify, and hold harmless The Flight Wall and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Site, App, and Device, or your violation of any term of these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Site and updating the "Last Updated" date. Your continued use of the Site, App, or Device after such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California and the United States, without regard to its conflict of law principles.

11. Data Processing & Privacy

Our Privacy Policy governs how we collect, use, and disclose information in connection with the Site, App, and Device. By using the App and Device, you acknowledge that their operation requires the transmission and processing of: (i) Wi‑Fi network credentials during setup, (ii) the Device’s IP address, and (iii) configuration settings such as user-defined geographical bounds (and minimal telemetry necessary to operate and secure the services, if any). We do not sell or share personal information for cross-context behavioral advertising. For details, please review our Privacy Policy.

12. No Account / Device-Based Identification

We do not require or maintain user accounts. Any identification of a user or Device for support or legal rights purposes will be based solely on device-specific identifiers (such as serial number, MAC address, or IP address).

13. Device Data Transmission

During setup, the App transmits your Wi‑Fi SSID and password to your Device so it can connect to your network. This transmission is temporary and encrypted. We do not store your Wi‑Fi password on our servers. You are solely responsible for the security of your Wi‑Fi network and devices.

14. Location Data Disclaimer

The geographical area you select in the App may reflect a residence or typical location. The Device processes this location information solely to provide flight display services in the selected area.

15. Data Subject Rights

Depending on your jurisdiction (including GDPR and CCPA/CPRA), you may have rights related to personal data, such as the right to access, delete, or restrict processing. These rights are described in our Privacy Policy. Because we do not maintain accounts, exercising such rights may require you to provide a device identifier (such as a serial number, MAC address, or IP address) so we can locate relevant records. We will verify and respond in accordance with applicable law.

16. Modifications to Service

We may modify, suspend, or discontinue features of the Device or App (including the availability of specific third-party flight data sources) at any time. Where changes materially and adversely affect core functionality, we will make reasonable efforts to provide notice via the Site and/or the App. We are not responsible for changes made by third-party data providers or for interruptions arising from such changes.
