This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, theflightwall.com (the "Site"), use our mobile application (the "App"), or use our physical Flight Wall devices (the "Devices"). This Privacy Policy forms part of our Terms of Service.

By using the Site, App, or Devices, you agree to the practices described here.

1. Who We Are and Scope

The Flight Wall is the controller for personal information processed in connection with the Site, App, and Devices. This Policy applies to information we process when you visit our Site, use our App, or connect a Device to our services.

2. No-Account Model and Identification

We do not require users to create an account to use the App or Device. We do not collect names, emails, or other direct identifiers through the App or Device. Any personal data we process is associated with your Device or network connection.

When you contact us for support or to exercise privacy rights, we may request your Device serial number, MAC address, or other device identifier to verify and fulfill your request.

3. Information We Collect

We collect only what we need to provide, secure, and support the service.

A. Purchase Information (via our payment processor)

When you purchase a Device, our third-party payment processor may collect your name, billing address, shipping address, email address, phone number, and payment card details. We receive only information necessary to fulfill your order (e.g., name, shipping address, and order details).

B. Device Data

  • Device serial number or hardware identifier
  • Device MAC address
  • Local network IP address
  • Public/WAN IP address (received when the Device connects to our servers)
  • Device connectivity status, uptime, firmware version, and basic health indicators

C. User-Selected Configuration Data

  • Geographical area you select in the App (e.g., coordinates or region) for flight tracking
  • Display filters and Device display preferences

We do not collect continuous precise geolocation from the Device. If you allow the App to access your mobile device location, it is used only to help you select a location; you may also enter a location manually.

D. Wi‑Fi Setup Information

During setup, the App transmits your Wi‑Fi network name (SSID) and password directly to the Device so it can connect to your home network. This information is transmitted only between your phone and the Device and is not transmitted to or stored on our servers.

E. Site and App Usage Data

  • IP address, approximate location derived from IP, browser type, operating system, device type
  • Access times, pages viewed, referring website address, and general log information

F. Device Analytics (Diagnostics)

We may collect limited diagnostic information from the Device (e.g., uptime, connection status, error logs) to monitor performance, identify bugs, and improve reliability. Where feasible, this data is de-identified or aggregated.

G. California Notice at Collection (CCPA/CPRA)

Over the past 12 months, we have collected the following categories of personal information: - Identifiers (e.g., Device identifiers, IP address) - Internet or other electronic network activity (e.g., Site/App interactions, logs) - Geolocation (limited to a user-selected configuration area; not precise geolocation) - Commercial information (purchase/order details as necessary to fulfill orders)

We do not sell or share personal information for cross-context behavioral advertising.

4. How We Use Your Information

A. Device Operation

  • Connect and authenticate the Device
  • Fetch and display flight data based on your selected geography and filters
  • Provide firmware and software updates (where applicable)

B. Security and Service Integrity

  • Enable connectivity, maintain service stability, and prevent abuse
  • Detect anomalies and troubleshoot technical issues

C. Customer Support and Communications

  • Respond to technical and customer support requests
  • Send technical notices, updates, security alerts, and administrative messages

Where GDPR/UK GDPR applies, we process personal data on the following bases: - Contractual necessity: to provide and support the core Device/App functionality you request - Legitimate interests: to secure our services, prevent abuse, and improve reliability - Legal obligations: to comply with applicable laws and regulations - Consent: where you grant App-level permissions (e.g., location access) or where required by law; you may withdraw consent at any time via your device settings

6. How We Share Your Information

We do not sell, trade, or rent your personal information. We may share information in these limited circumstances: - Service providers: hosting providers, flight data providers, payment processors, and support/diagnostics vendors. These providers are contractually obligated to protect your information and use it only for the specified purposes. - Legal and safety: to comply with law, enforce our terms, or protect rights, property, and safety. - With your direction or consent: when you ask us to share information.

We do not sell or share your personal information for cross-context behavioral advertising (CCPA/CPRA).

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. IP Addresses and Why We Collect Them

When your Device or browser connects to our services, we automatically receive your IP address to enable connectivity, maintain stability, prevent abuse, and troubleshoot issues. IP addresses are retained for a limited period as described in Section 8 (Data Retention).

8. Data Retention

  • IP addresses and server logs: retained for up to 90 days unless needed longer for security or legal reasons.
  • Device configuration (location, filters): stored for as long as needed to operate your Device and deleted upon request or when you stop using the service; we may retain minimal records as required by law.
  • Wi‑Fi credentials: never transmitted to or stored on our servers.
  • Diagnostics logs: retained for up to 180 days in de-identified or aggregated form where feasible.

9. International Data Transfers

We may process and store information in the United States. If you are in the EEA/UK and your information is transferred outside your jurisdiction, we use appropriate safeguards such as the European Commission’s Standard Contractual Clauses (and UK addendum, where applicable). We implement measures designed to protect your information consistent with applicable law.

You may have the right to request access, rectification, erasure, restriction, objection, and portability. Where processing is based on consent, you may withdraw consent at any time.

Device-Based Verification

Because we do not maintain user accounts, we may ask for your Device serial number, MAC address, or other device identifier to verify and fulfill your privacy requests.

11. Data Security

We use industry-standard administrative, technical, and physical safeguards designed to protect your information. However, no electronic transmission or storage can be guaranteed to be 100% secure. The security of your Device’s connection to your Wi‑Fi network depends on the safeguards you implement on your network.

12. Children’s Privacy

Our Site, App, and Devices are not intended for children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take steps to delete it.

We may update this Privacy Policy from time to time. We will post any changes on this page and update the “Last Updated” date. We encourage you to review this Privacy Policy periodically.
